4. TRACKING TECHNOLOGIES AND COOKIES

We use cookies and similar tracking technologies (like localStorage and sessionStorage) to track activity on our Services and hold certain information. These technologies are essential for providing you with a seamless and personalized study experience.

4.1 Essential Cookies (Required)

These are strictly necessary to provide you with services available through our website and to use some of its features, such as access to secure areas.

  • Payments (Stripe): Essential cookies used for secure payment processing and checkout functionality.
  • Security: Cookies used for fraud prevention and protecting your account from unauthorized access.

8. CONTROLS FOR DO-NOT-TRACK FEATURES

Most web browsers and some mobile operating systems include a Do-Not-Track ("DNT") feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. No uniform technology standard for recognizing and implementing DNT signals has been finalized. As such, we do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online. If a standard for online tracking is adopted that we must follow in the future, we will inform you about that practice in a revised version of this Privacy Policy.

12. EDUCATIONAL CONTENT AND RECORDINGS

This section specifically addresses the collection, use, and legal considerations surrounding educational content, including lecture recordings and study materials.

User Responsibility for Recording Authorization

IMPORTANT: You are solely responsible for ensuring that you have the legal right and necessary permissions to record lectures, classes, or any educational sessions. By uploading audio recordings to the Services, you represent and warrant that:

  • You have obtained all necessary permissions and consents from instructors, professors, or other participants before recording
  • Your recording complies with all applicable federal, state, and local laws, including but not limited to wiretapping and consent laws
  • Your recording complies with your educational institution's policies regarding class recordings
  • You will use recordings solely for personal educational purposes and not for commercial distribution
  • You will not share recordings containing other students' voices or likenesses without their explicit consent

Legal Considerations

Recording laws vary by jurisdiction. In the United States, federal law permits recording if at least one party consents (known as "one-party consent"), but many states require all parties to consent ("two-party consent" or "all-party consent"). Users must familiarize themselves with applicable laws in their jurisdiction.

Educational institutions may have specific policies regarding class recordings. Failure to comply with these policies may result in academic disciplinary action. We are not responsible for any violations of institutional policies.

Intellectual Property in Educational Content

  • We employ AI models to generate study notes, summaries, flashcards, and quizzes
  • Content is stored securely on our servers and third-party cloud storage providers
  • We may use anonymized and aggregated data to improve our AI models and services
  • We do not share your specific recordings or transcriptions with third parties except as necessary to provide the Services or as required by law

Content Ownership and Rights

You retain ownership of all content you upload to the Services. However, by uploading content, you grant us a worldwide, non-exclusive, royalty-free license to:

  • Store, process, and transmit your content as necessary to provide the Services
  • Generate derivative works (notes, summaries, flashcards, quizzes) from your content
  • Use anonymized and aggregated data for service improvement and AI model training

This license terminates when you delete content from your account, except for content that has been shared with other users or is retained as required by law.

Prohibited Uses of Educational Content

You may NOT use the Services to:

  • Record or upload content for which you do not have proper authorization
  • Commercially distribute, sell, or license educational recordings or materials

If your educational institution has entered into a partnership agreement with Lectura AI, additional terms may apply. Your institution may request access to aggregated usage data or may have specific requirements regarding data storage and processing. We will notify users of any such arrangements.

Content Removal

We reserve the right to remove any content that:

  • Violates this Privacy Policy or our Terms of Service
  • Infringes upon intellectual property rights
  • Violates applicable laws or regulations
  • Is reported as unauthorized by content owners or subjects
  • Contains harmful, offensive, or inappropriate material

If we believe content violates legal requirements or rights of others, we may report such content to appropriate authorities.

13. DATA RETENTION

14. INTERNATIONAL DATA TRANSFERS

Your information, including Personal Data, may be transferred to — and maintained on — computers located outside of your state, province, country, or other governmental jurisdiction where the data protection laws may differ from those of your jurisdiction.

If you are located outside Canada and choose to provide information to us, please note that we transfer the data, including Personal Data, to Canada and process it there.

Your consent to this Privacy Policy followed by your submission of such information represents your agreement to that transfer.
